Lawyer-supported mediation

Lawyer-supported mediation is a "non-adversarial method of alternative dispute resolution (ADR) to resolves disputes, such as to settle family issues at a time of divorce or separation, including child support, custody issues and division of property".[1]

The approach sets out to integrate the contribution of family lawyer or solicitor with that of a family mediator.[2] Users of lawyer-supported mediation first meet their respective lawyers to take advice before jointly attending mediation sessions. Legal advice is taken between sessions to inform options being discussed at mediation. Following mediation, the lawyers are called upon to review any agreement reached and to make aspects of it made legally binding. Since neither lawyer is initially being retained as a negotiator or litigator, the cost of legal advice is typically fixed for clients choosing lawyer-supported mediation.

In the event of lawyer-supported mediation failing to deliver a partial or full agreement, both parties are free to retain their respective lawyers to pursue litigation. This is not the case with collaborative law where a breakdown in roundtable negotiations requires each party to instruct a new family lawyer before proceeding with court action.[3][4]

Mediating construction cases is often very, very different than mediating a typical two party case. First, most construction cases involve more than two parties. Sometimes, they involve ten or more parties - general contractors, sub-contractors, insurance companies. There's a premium placed on designing construction mediations. The primary reason for that involves the presence of insurance and insurance coverage issues. If those aren't addressed before mediating the underlying dispute, the mediation goes nowhere. So, mediating construction cases usually involves phased mediation. It does take the cooperation of the parties, their lawyers and their insurers to work at this, and sometimes, that's not easy to obtain. In addition, the personalities of contractors are often very challenging. The contractor personality is often a maverick of sorts, when compared to other walks of life. So a lot of work needs to be done at the front end of mediation. And the parties should expect, realistically, if there are large numbers of them, and high dollars in controversy, they should expect that it's going to take more than one day of mediation to get the job done. As a lawyer, I litigated construction cases, including marine construction litigations that involved complex legal and factual issues, and substantial amounts of money. Before law school, I managed the construction and leasing of a commercial office building, and I also worked as a construction worker for a number of years. I have successfully mediated and arbitrated numerous construction cases since I became a full time neutral more than twenty years ago. So really, it's a composite of all of these experiences that enables me to work effectively and help the parties achieve resolution.

United Kingdom

Lawyer-supported mediation is being pioneered in the United Kingdom (UK). A pilot service covering Greater London began in 2012.[5] More recently, UK retail giant the Co-op launched a fixed fee legal advice service for clients choosing family mediation.[6]

According to figures released by the UK's Legal Services Commission, the success rate of publicly funded mediations in 2009/2010 stood at 70%.[7]

United States

In 1989, Arlen F. Gregorio created the first law partnership that focused exclusively on the mediation of civil trial matters.[8] The firm is known as Gregorio, Haldeman & Rotman and is located in San Francisco.[9] [10]
