Licensing and fair use justification

It is submitted that use of the image in the article "Ötzi" is fair under U.S. copyright law, and the laws of other jurisdictions where applicable, for the following reasons:

  • The image is not replaceable. It is believed to be the original photograph of Ötzi in situ taken by one of its co-discoverers, Helmut Simon, when the body was first found in September 1991. Therefore, it is highly unlikely that an image which does not rely on the doctrine of fair use is easily obtainable.
  • The image is small and of a low resolution.
  • Use of the image in the article is unlikely to impair the sale of the original, high-quality photograph.
