The author asserts the image qualifies for fair use for the following reasons:

  1. EA Games and its affiliates have not released cover arts into public domain.
  2. The image is needed to illustrate a mandatory computer and video games' cover art and improve the quality of the articles in question, per Wikipedia:Article development.
  3. The image is not intended to hinder the copyright holders' ability to market and sell its games.
  4. This image is deemed sufficiently small and below the maximum size of "web-resolution" images.
