Although this image is subject to copyright, I feel that the fair use provisions of U.S. copyright laws cover its use because:

  1. The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes – The purpose of using this image is to profile a noted folk song collector of whom public images are rare. The use is for informational purposes in an encyclopedia article through a non-profit entity.
  2. The nature of the copyrighted work – The image is from the estate of the subject, included with her ballad collection which was deeded to the special collections of Middlebury College, provided “that it should be used as a resource for academic and scholarly research.” The scanned image is of much lower resolution than the original (copies made from it will be of very inferior quality).
  3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole – The image is but one of a large collection of artifacts from the Helen Hartness Flanders estate. Its original intent was to illustrate Flanders’ role as a collector and author.
  4. The effect of the use upon the potential market for or value of the copyrighted work. – The imagery connected with the Helen Hartness Ballad Collection at Middlebury College are intended be used as a resource for academic and scholarly research, not as a source of profit. Images of Flanders have negligible market value.
