Fair Use Rationale

This is a sound sample from a commercial recording. Its inclusion in the article Music of Madagascar and Rakoto Frah is claimed as fair use because:

  1. In "Music of Madagascar", it illustrates an educational article that specifically discusses the traditional performance of the instrument featured here, as well as the artist that performs it. In "Rakoto Frah", it is selected to illustrate the performance style of this particular artist of the same name, as the song is dedicated to him by name and is representative of the virtuoso style of sodina performance that earned him national and international celebrity.
  2. It is a sample of about 23 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording.
  3. It is of a lower quality than the original recording.
  4. It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
  5. It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.

Specific rationale for "Rakoto Frah"

  1. The sodina is an iconic traditional instrument of Madagascar.
  2. Rakoto Frah is considered the master of sodina performance. In his lifetime he was an ambassador of Malagasy music and his legacy remains a national treasure.
  3. This song features Rakoto Frah performing the sodina, in a song dedicated to him entitled "Rakoto Frah", illustrating his status as a performer of sodina in Madagascar.
